Terms
1. Services
The Photographer agrees to provide real estate photography services (“Services”) as outlined in the booking confirmation or invoice. Services may include interior, exterior, detail, and/or aerial photography as agreed upon at the time of booking.
2. Property Preparation & Access
The Client is responsible for ensuring the property is clean, staged, and photo-ready at the scheduled time. The Photographer is not responsible for moving furniture, personal items, or cleaning the property.
The Client must ensure timely access to the property. Delays caused by lack of access, unprepared spaces, or restricted areas may result in reduced coverage or additional fees.
3. Scheduling, Rescheduling & Cancellations
Rescheduling requests made 24 hours or more before the scheduled shoot may be accommodated at no charge.
Reschedule within 12 hours of the scheduled shoot may be charged up to 50% of the session fee.
Same-day cancellations or no-shows may be charged 100% of the session fee.
Weather-dependent services (exterior or aerial photography) may be rescheduled at the Photographer’s discretion for safety or quality reasons.
4. Payment Terms
Payment is due upon delivery of final images unless otherwise agreed in writing. Images will not be released until payment is received in full. Late payments (one week) may result in revoked usage rights or additional fees. If payment is not received after 3 weeks additional action will be taken
5. Image Delivery
Final edited images will be delivered digitally within 24 hours, unless otherwise specified. Delivery times may vary based on scope of work or volume. Rush delivery may be available for an additional fee.
6. Copyright & Licensing
The Photographer retains full copyright ownership of all images.
Upon full payment, the Client is granted a limited, non-exclusive, non-transferable license to use the images solely for:
Marketing and advertising the specific property photographed
MLS listings and real estate platforms
Social media and online marketing related to the property
Images may not be:
Sold, transferred, sublicensed, or shared with third parties (builders, designers, stagers, publications, or other agents)
Used for unrelated marketing, branding, or future listings
Additional licensing is available upon request.
7. Image Modification
The Client may not alter, edit, apply filters, or manipulate images without written consent, except for basic resizing or cropping required by MLS platforms.
8. Photographer Promotion
The Photographer may use images for portfolio display, website content, social media, advertising, and self-promotion unless the Client provides written notice requesting otherwise prior to the shoot.
9. Liability
The Client is responsible for the condition of the property, including securing pets, people, valuables, and fragile items. The Photographer is not liable for issues related to property condition, staging decisions, or third-party listing platforms.
10. Limitation of Liability
In the event the Photographer is unable to deliver images due to illness, equipment failure, or unforeseen circumstances, liability is limited to a full refund of fees paid. No additional damages may be claimed.
11. Acceptance of Terms
Booking a photography session constitutes acceptance of these Terms & Conditions.
